2. APPLICABLE LAW
ELKO EP Kuwait operates from and supplies its online store within the State of Kuwait.
These Terms and purchases made through the online store are governed by applicable laws and regulations of the State of Kuwait.
Nothing in these Terms is intended to remove, restrict, waive, or replace any mandatory consumer right or remedy available under Kuwaiti law.
If any provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail.
3. DELIVERY AREA
Orders placed through shop.elkoep-kw.com are currently available for delivery to addresses within the State of Kuwait only.
This limitation concerns the customer delivery destination. It does not mean that every product is dispatched from inventory physically located in Kuwait. Depending on stock availability and the applicable fulfilment arrangement, products may be dispatched from ELKO EP Kuwait inventory in Kuwait or supplied and shipped from ELKO EP s.r.o. in the Czech Republic, including direct shipment to the customer's Kuwait address.
We do not currently offer standard customer delivery to addresses outside Kuwait or standard GCC delivery through the online store.
A customer should not provide a delivery address outside Kuwait unless ELKO EP Kuwait has separately agreed in writing to another arrangement outside the standard online-store service.
4. ELIGIBILITY AND AUTHORITY
By placing an order, you confirm that you have the legal capacity and authority required to enter into the transaction.
Where an order is placed on behalf of:
• A company
• Contractor
• Institution
• Project
• Organization
• Another person
you confirm that you are authorized to place the order or otherwise act on that party's behalf.
You must provide accurate and complete information when using our Services.
5. TECHNICAL NATURE OF PRODUCTS
Many products supplied by ELKO EP Kuwait are specialist electrical and automation components.
Before ordering, customers should verify that the selected product is technically suitable for the intended application.

• Commissioning certification
• A guarantee that a product is suitable for every possible application
Customers remain responsible for providing complete and accurate information regarding their intended use.
7. PRODUCT INFORMATION
We make reasonable efforts to ensure product information displayed through our store is accurate.

9. PRICES
Unless expressly stated otherwise, prices displayed through the online store are shown in Kuwaiti Dinars (KWD).

A later price change will not ordinarily affect an order already validly accepted, except where there is:

After submitting an order, you may receive an automated acknowledgement confirming that the order has been received.
An automated acknowledgement does not necessarily mean that an order has been finally accepted.

Displaying a product on the website does not guarantee immediate availability. Unless expressly identified otherwise, an "available" or "in stock" indication does not necessarily mean that the product is physically located in Kuwait.
If availability materially changes after an order is placed, we may contact the customer regarding:

• Alternative product
• Partial fulfilment
• Cancellation
• Refund
15. SPECIAL-ORDER PRODUCTS
Certain products may be:
• Sourced specifically for a customer
• Imported specifically against an order
• Manufactured to order
• Ordered in unusual quantities
• Configured for a particular project
• Programmed according to customer requirements
Different cancellation or return conditions may apply to special-order products where permitted by applicable law.
Where practical, material special-order conditions will be communicated before the purchase is finalized.
A product does not become a special-order product merely because ELKO EP Kuwait elects to fulfil an ordinary customer order from ELKO EP s.r.o. in the Czech Republic rather than from local Kuwait inventory.
Nothing in this section removes rights relating to a defective, incorrect, or otherwise legally non-conforming product.
16. FULFILMENT FROM ELKO EP CZECH REPUBLIC
Where a product is unavailable from local Kuwait inventory, or where another approved supply arrangement applies, ELKO EP Kuwait may request ELKO EP s.r.o. in the Czech Republic to supply the product and, where appropriate, ship it directly to the customer's delivery address in Kuwait.
The fulfilment request may be transmitted by ELKO EP Kuwait personnel or through an approved automated, Shopify-connected, integration, application, email, electronic, or other internal fulfilment workflow.
Unless the applicable transaction documents expressly state otherwise:
• The customer's purchase remains a transaction with ELKO EP Kuwait
• ELKO EP Kuwait remains the customer's seller for the online-store transaction
• ELKO EP s.r.o. acts as a supply, manufacturer, or fulfilment source for the applicable shipment
• The customer delivery destination remains Kuwait even where the shipment originates in the Czech Republic
• An international courier, freight forwarder, customs-related provider, or other logistics provider may participate in fulfilment
For fulfilment purposes, ELKO EP Kuwait may provide ELKO EP s.r.o. and applicable logistics providers with the customer and order information reasonably necessary to prepare and deliver the shipment, in accordance with our Privacy Policy.
Direct fulfilment from the Czech Republic does not by itself convert an ordinary product into a special-order product and does not remove or reduce any mandatory consumer right.
17. PAYMENT
Available payment methods will be displayed during checkout or stated in an applicable quotation.
Payment may be processed through services including:
• Tap Payments
• Shopify checkout and related e-commerce functionality
• KNET
• Payment gateways
• Banks
• Card networks
• Digital wallets
• Other authorized payment providers
You confirm that you are authorized to use the payment method submitted.
We may hold or cancel an order where:
• Authorization fails
• Payment cannot be verified
• Fraud is reasonably suspected
• Another legitimate payment-security issue exists
18. PAYMENT INFORMATION
Complete payment-card information may be handled directly by Tap Payments, Shopify-related checkout technology, and/or other authorized payment providers rather than stored directly by ELKO EP Kuwait.
Where card credentials are entered directly into a secure Tap Payments or other authorized payment-provider environment, ELKO EP Kuwait does not ordinarily receive or store the complete card number or card security code, subject to the actual technical configuration of the applicable payment method.
ELKO EP Kuwait may retain or process non-sensitive transaction information reasonably necessary for order administration, accounting, refunds, chargebacks, disputes, fraud prevention, and customer support.

19. BUSINESS AND COMMERCIAL PURCHASES
Customers ordering on behalf of a business should provide accurate:

• Billing details
• Delivery details
• Purchase-order information
• Authorized contact information
where applicable.
Some project, bulk, or commercial transactions may also be governed by separately agreed written terms.
20. SHIPPING AND DELIVERY
All standard online-store deliveries are limited to addresses within Kuwait. The shipment itself may originate from Kuwait or, where applicable, directly from ELKO EP s.r.o. in the Czech Republic.
Delivery is governed by our Shipping & Delivery Policy.
Any delivery timeframe is an estimate unless expressly confirmed as guaranteed in writing.
Delivery timing may be affected by:
• Stock availability
• Order processing
• Delivery location
• Traffic
• Weather
• Public holidays
• Courier availability
• Project-site access
• Supplier or manufacturer lead times
• International transportation
• Customs or import processing
• Other circumstances outside our reasonable control
21. RETURNS AND REFUNDS
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy and applicable Kuwait law.
Eligible products may generally be subject to the applicable 14-day return or exchange framework from the date of purchase shown on the applicable invoice, subject to Kuwait law and the conditions of our Return & Refund Policy.
The conditions applicable to a return may differ depending on whether the product is:
• Unused
• Opened
• Installed
• Wired
• Energized
• Configured
• Defective
• Damaged
• Incorrectly supplied
• Specially ordered
• Customized
Where a product was fulfilled from outside Kuwait, including directly from ELKO EP s.r.o., the customer should follow ELKO EP Kuwait's authorized return instructions and should not independently ship the product internationally for return unless specifically instructed to do so.
Nothing in these Terms removes any mandatory return, replacement, repair, refund, or exchange right.
22. FIVE-YEAR MANUFACTURER WARRANTY
All products sold by ELKO EP Kuwait are covered by a five (5) year manufacturer warranty, subject to the applicable warranty terms and exclusions described in our Warranty Policy.
Unless expressly agreed otherwise in writing, the five-year manufacturer warranty period begins from the documented date of purchase shown on the applicable invoice or sales record.
The warranty generally applies to eligible manufacturing or product defects.
Warranty coverage does not automatically apply to damage caused by circumstances outside a genuine product or manufacturing defect.
23. WARRANTY EXCLUSIONS
Subject to applicable law, the five-year manufacturer warranty does not ordinarily cover damage or failure caused solely by circumstances such as:
• Incorrect installation
• Incorrect wiring
• Incorrect voltage
• Incorrect polarity
• Overload
• Operation outside published ratings
• Electrical surges or external power faults
• Misuse
• Accidental physical damage
• Unauthorized modification or repair
• Unsuitable environmental conditions
• Water or dust exposure outside the applicable rating
• Improper commissioning
• Incompatible third-party equipment

Nothing in these warranty exclusions removes liability for a genuine covered defect or any mandatory statutory right.
24. WARRANTY INSPECTION
A reported fault may require technical assessment before warranty coverage can be confirmed.
Inspection may be undertaken by:

• ELKO EP
• The manufacturer
• Supplier
• Authorized distributor
• Authorized service centre
• Another qualified technical representative
Depending on the confirmed fault and applicable warranty terms, the remedy may include:
• Repair
• Replacement

• Another remedy required by applicable law
25. INSTALLATION AND ELECTRICAL SAFETY
Electrical and automation products should be installed, configured, tested, and commissioned in accordance with:
• Manufacturer instructions
• Published technical specifications
• Wiring diagrams
• Applicable electrical requirements
• Project specifications
• Appropriate professional practice
Where required, work should be performed by a suitably qualified:

Customers should not undertake electrical work for which they are not appropriately qualified.
26. OPERATING WITHIN PUBLISHED RATINGS
Products must be used within their applicable manufacturer specifications.
Customers are responsible for verifying requirements such as:

• Switching capacity
• Load type
• Environmental conditions
• Protection requirements
• Mounting
• Communication parameters
• Operating limits
Use outside the published specification may result in malfunction, damage, or a safety risk and may affect warranty coverage where that use causes the reported fault.
27. PRODUCT COMPATIBILITY
Compatibility between electrical or automation products can depend on matters including:

• Software version
Unless compatibility has been expressly confirmed for a defined configuration, customers remain responsible for verifying interoperability within their complete system.
28. MANUFACTURER DOCUMENTATION
Customers should follow current applicable manufacturer documentation when installing, configuring, or operating a product.
Where general website information differs from current official manufacturer documentation concerning technical installation or safe operation, the applicable current manufacturer documentation should ordinarily be followed.
Customers may contact ELKO EP Kuwait where clarification is required.
29. PROJECT AND SYSTEM RESPONSIBILITY
Unless ELKO EP Kuwait has separately agreed in writing to provide design, engineering, system integration, installation, programming, testing, or commissioning services, purchasing a product does not make ELKO EP Kuwait responsible for the overall design or operation of the customer's complete project.
The relevant customer, contractor, consultant, engineer, panel builder, or system integrator remains responsible for matters including:
• Electrical design
• Calculations
• System architecture
• Equipment selection
• Regulatory compliance
• Protection
• Wiring
• Programming
• Testing
• Commissioning
• Project coordination
30. CUSTOMER ACCOUNTS
Where customer accounts are available, you are responsible for protecting your account credentials.
You should promptly notify us if you believe your account has been accessed without authorization.
We may suspend or restrict an account where reasonably necessary for:
• Security
• Fraud prevention
• Legal compliance
• Material violation of these Terms
31. PROHIBITED USES
You may not use our website or Services to:
• Violate applicable law
• Engage in fraud
• Impersonate another person or entity

Unless expressly stated otherwise, purchases made through the store are transactions with:

and not purchases from Shopify.
Likewise, where ELKO EP s.r.o. in the Czech Republic fulfils or directly ships an online-store order on ELKO EP Kuwait's behalf, that fulfilment arrangement does not by itself make ELKO EP s.r.o. the customer's seller unless the applicable transaction documents expressly state otherwise.
35. PRIVACY
Personal information is handled in accordance with our Privacy Policy.

Any dispute relating to:

will be subject to the competent authorities and courts of the State of Kuwait, unless applicable law provides otherwise.
Nothing in these Terms prevents a customer from exercising any right to contact the applicable consumer-protection or governmental authority.
